Under UK data protection law, the Taxi Company’s legal status is that of a data controller and in such capacity it will securely store and process your personal information provided to it. Data controller is a legal term used in the Data Protection Act 1998 (the Act) to signify the person who controls what to do with any given personal information. We suggest that Taxi Companies register with the Information Commissioner’s Office as data controllers. Our legal status is that of a data processor and in this capacity we will process personal information which you have provided to us. Data processor is a legal term used in the Act to signify a person who processes data on behalf of a data controller. As a data processor we will only process your data in order to pass information between you and the Taxi Company, whose instructions we will follow in any such processing.
Collection of information
- your name;
- company/organisation name (where applicable);
- email address;
- phone number;
- bank / payment card details (we do not store this information, we just process it for payment handling through merchant accounts of Cabs.com and Taxi Company)
- IP address;
- device ID;
- data provided by cookies and other similar technologies;
- functional data such as registration and account data;
- usage data, such as, activity information;
- marketing communication preferences and
- your use of the Cabs.com Service (including information observed, derived or inferred by the Taxi Company or Cabs.com).
How is your personal information used?
The Taxi Company and Cabs.com will use the personal information you provide in order to:
- administer your account;
- provide you with use of and personalised visits to the Cabs.com Service;
- better understand how users interact with and use the Cabs.com Service;
- enhance our customer services;
- improve our security measures;
- develop our offering and the layout of the Cabs.com Service to ensure that our services are as useful and enjoyable as possible; and
- contact you.
With whom is your personal information shared?
Your personal information will only be disclosed by the Taxi Company to us and applicable payment gateway merchant accounts.
The Taxi Company and Cabs.com may disclose depersonalised data (such as aggregated statistics) about the users of the Cabs.com Service in order to describe sales, customers, traffic patterns and other Cabs.com Service information to prospective partners, advertisers, investors and other reputable third parties and for other lawful purposes, but these statistics will include no personally identifying information.
The Taxi Company and Cabs.com may occasionally be required by law, court order or governmental authority to disclose certain types of personal information, for example in the administration of justice or where they have to defend themselves legally, or in the event of a reorganisation, sale or takeover.
Where is your data stored?
The personal data that we collect from you as a data processor is stored inside the European Economic Area (“EEA”) on ISO27001 accredited hosting services. As a data processor, all of the customer data uploaded to Cabs.com by you is stored inside the EEA on secure password encrypted servers. Should your personal data be processed by any of our GDPR-compliant Service Providers, in order to fulfil our services to you, that are based outside of the EEA – your data and the transfer is protected under the EU-US Privacy Shield framework.
For how long we keep your data?
We retain personal data on our systems for as long as is necessary for the relevant service, as long as is set out in any relevant contract you hold with us or for as long as an account is active. We will only ever keep data as is necessary to comply with our legal obligations, resolve disputes and enforce our contractual agreements.
The requirements of data protection law
- will only collect sufficient personal information for the uses set out above;
- will endeavour to keep your personal information up-to-date;
- will not retain your personal information longer than necessary unless required to do so by law;
- will not transfer your personal information outside the European Economic Area unless safeguards are in place to protect your personal information to the standards that apply within the EEA.
The Taxi Company is committed to protecting the security of your personal information, and uses a variety of security technologies and procedures to help protect your personal information from unauthorised access, use, or disclosure. For example, personal information you provide is stored on computer systems with limited access that are located in facilities to which access is limited.
Reviewing your personal information
In some cases, you can review and correct personal information provided through the Cabs.com Service by going to the page on which you provided the information. In all cases, you can make a subject access request to review your personal information collected via the Cabs.com Service or ask the Taxi Company and/or us to stop using it by sending an email to firstname.lastname@example.org. We and/or the Taxi Company (as applicable) may take steps to verify your identity before providing you access to your personal information and may request a small administrative fee. You can help us and the Taxi Company to maintain the accuracy of your information by providing notice of any change.
How can you delete your data from Cabs.com?
You can always send us an email to email@example.com or contact our Customer Services Team at +44 020 8608 5871 during working hours and request that your data be deleted. Please note, however that by deleting your personal data your account will be affected and in certain cases, relating to ongoing contracts and any applicable obligations we may not be able to completely action your request, until the contract has been fulfilled.
How can you opt-out from Cabs.com communications?
You can decide what communications you receive from Cabs.com and by what methods. However certain types of data that we collect are a necessity in order for you to use our service and access your account, as a result you will not be able to opt out from this type of data collection.
Please let us know if you would like to update your marketing preferences, these can be changed at anytime by emailing firstname.lastname@example.org or by using the ‘unsubscribe’ link on the footer of our emails.
We will only ever contact you about our products or services and any offers or incentives that may be of interest via the methods you have previously chosen. These could be by email, post, landline or mobile phone calls, and SMS.
If we don’t hear back from you by the 28 March 2019 – the date when European Union’s General Data Protection Regulation (GDPR) takes effect – we’ll keep what we have on file as your chosen preferences. Please remember that these can be amended at anytime, simply just let us know.
